Marijuana question will appear on MA ballot after challenge fails

On July 21, the state’s Ballot Law Commission overruled a challenge from Dorchester resident Kevin Gilnack, who had questioned the validity of the final set of signatures supporting the proposal, saying some were “non genuine” or “illegible,” among other complaints.

After two days of hearings, which included testimony from a forensic document examiner, the commission found that Gilnack did not reach the “burden of proof” to disqualify enough signatures to prevent it from getting on the ballot.

"This is a victory not just for our coalition, but for every Massachusetts voter who believes citizens, not political gamesmanship, should decide important public policy questions," said Wendy Wakeman, spokesman for the coalition. "Today's ruling affirms that our volunteers, supporters, and signers followed the law, and that this campaign earned its place on the ballot."

The marijuana proposal now officially joins eight other questions that have qualified for statewide ballot on November 3, 2026.

What is the marijuana ballot question?

While Massachusetts has increasingly legalized marijuana in recent years, this question would repeal Chapters 94G and 64N, provisions in the current law that allow for the drug to be sold commercially in the state. 

It would also repeal adults’ right to cultivate cannabis at home.

However, it wouldn't completely turn back the clock on cannabis laws. It would decriminalize possession of more than one ounce but less than two ounces, and a violation of the law would only be a civil offense with a fine $100. While retail sales wouldn’t be allowed, adults would still be able to gift cannabis to each other.
